Royal Dutch Shell plc – On April 11, 2007, Royal Dutch Shell plc signed a settlement agreement to compensate non-US investors for the damage caused by various false statements of the company, relating to its proved oil reserves from 1999 to 2003. The settlement value was initially $448.6 million and has now increased to over $500 million after the US class action also settled. It will result in substantial refunds to mostly European investors after the Non-US class was excluded from the now settled US securities class action. What remains is a final hearing of the Dutch Court on November 20, 2008 to decide on the fairness of the settlement and the adequacy of the representation of all Non-US investors by the Dutch foundation formed for this purpose. A final declaration of the Dutch court will make the settlement binding on all members and represented investors.  

DRRT was instrumental in obtaining this positive and surprising result for its clients, who were facing dismissal from the US class action for lack of jurisdiction and would not have had any effective alternatives for recovery. The result is the first “class-action-type” settlement in securities litigation matters in Europe and we are proud to be part of it. All investors who bought Shell securities between 4/8/1999 and 3/18/2004 qualify for a portion of the settlement and will be able to submit their applications for refunds after the final hearing. The participation of affected investors in the Dutch foundation in order to support the settlement at this time is encouraged and without financial consequences. An amended petition to recognize and approve the settlement has already been filed with the Dutch court in February 2008 and notification to all potentially interested parties will go out in May 2008.
